Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and NovaStream ("we," "our," or "us") regarding your access to and use of the NovaStream media player application for Roku and our web management portal at qyvo.cc (collectively, the "Service").
By installing, downloading, accessing, or using NovaStream, you agree to be bound by these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Service and must immediately uninstall and discontinue use.
Core Principle: Pure Media Player
NovaStream does not supply, host, broadcast, or sell any media, television channels, movies, or video content.NovaStream is strictly a client playback software that plays digital media provided solely by you through your own third-party playlists, Xtream Codes credentials, or M3U URLs.
1. Eligibility and Account Registration
To use the Service, you must be at least 18 years of age or the age of legal majority in your jurisdiction. By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms.
Device pairing is executed via your device hardware identifier (MAC address). You are solely responsible for all activities conducted through your device MAC address.
2. User Content and Copyright Warranty
As a condition of using NovaStream, you acknowledge and agree that:
- Bring Your Own Content (BYOC): You must provide your own playlist sources. NovaStream does not include any pre-configured playlists or content streams.
- Legal Ownership & Authorization: You represent and warrant that you possess all necessary rights, licenses, consents, and permissions to access, stream, and view any content loaded into the application.
- Zero Endorsement: NovaStream has no affiliation with any third-party content providers, IPTV services, or stream distributors. We do not inspect, endorse, or verify the legality of any third-party content.
- Copyright Infringement: We respect intellectual property rights. Using NovaStream to stream pirated or unauthorized copyrighted material is strictly prohibited and constitutes a direct breach of these Terms.
3. Prohibited Activities
You agree not to engage in any of the following prohibited behaviors:
- Attempting to reverse-engineer, decompile, disassemble, or tamper with the application code or backend APIs.
- Using automated systems, scrapers, or bots to interact with our web portal or Edge Functions.
- Circumventing licensing controls, MAC authentication, or payment verification routines.
- Reselling, sublicensing, or distributing the Service without prior written authorization from NovaStream.
- Transmitting malicious payloads, SQL injection, cross-site scripting (XSS), or interfering with service availability.
4. Subscriptions, Pricing, and Payments
4.1 Plans and Billing
NovaStream provides trial access followed by premium license tiers (such as 1-Year or Lifetime access) as described on our Activation page. All payments are billed upfront and processed securely through Stripe.
4.2 Refund Policy
Because NovaStream provides a free trial period allowing users to fully test player compatibility on their device prior to purchase, payments are generally non-refundable once the activation key or extension has been provisioned, except where mandatory statutory consumer protection laws apply.
4.3 Taxes and Processing Fees
You are responsible for any applicable local sales, use, or value-added taxes (VAT) related to your license purchase.
5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, NOR DO WE WARRANT THE STABILITY, SPEED, OR AVAILABILITY OF THIRD-PARTY MEDIA STREAMS PROVIDED BY THE USER.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL NOVASTREAM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE, OR ANY CONTENT ACCESSED THROUGH THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO NOVASTREAM IN THE PRECEDING TWELVE (12) MONTHS.
7. Indemnification
You agree to defend, indemnify, and hold harmless NovaStream and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of and access to the Service; (b) your violation of any provision of these Terms; or (c) any claim that media or content accessed by you caused damage to or infringed the intellectual property rights of a third party.
8. Termination
We reserve the right, in our sole discretion and without notice, to terminate or suspend your license and access to the Service for any reason, including without limitation if you breach these Terms, tamper with security protections, or engage in abusive or unlawful behavior.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of incorporation of NovaStream, without regard to its conflict of law principles. Any dispute arising under or in connection with these Terms shall be settled exclusively in the competent courts of that jurisdiction.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. We will indicate the date of the most recent revision by updating the "Last updated" date at the top of this document. Continued use of the Service following any revisions indicates your acceptance of the updated Terms.
